(Applicable to all Services: Scholarship Acquisition, College Admission, Educational Loan, Mess & Hostel, and Placement Assistance)

These Terms of Use (“Terms” / “Agreement”) govern the access to and use of Biginius.com and all services offered therein. By using our platform, you agree to comply with these Terms in their entirety.

1. Defined Terms
For the purpose of this Agreement, the following terms shall have the meanings assigned to them below. The definitions apply to both singular and plural forms, and to any derivative forms thereof.

1.1 “Biginius.com” / “Company” / “We” / “Us” / “Our”
Refers to Biginius.com, including its owners, management, employees, agents, and authorized representatives.

1.2 “User” / “Subscriber” / “You” / “Your”
Refers to any individual, parent/guardian, or authorized representative who registers on the platform, subscribes to, or avails any Service provided by Biginius.com.

1.3 “Services”
Refers collectively to all services provided by Biginius.com, including but not limited to:

• Scholarship Acquisition
• College Admission
• Educational Loan
• Mess & Hostel Accommodation Assistance
• Placement Assistance

1.4 “Service Commencement Date”
The date on which Biginius.com formally begins providing the chosen Service(s), as communicated via email, SMS, or user dashboard notification.

1.5 “Subscription Plan”
Refers to the specific paid or unpaid package chosen by the User, detailing scope, duration, and applicable terms.

1.6 “Third Party”
Any entity or person not directly employed by Biginius.com but involved in delivering the Service, such as banks, educational institutions, hostels, employers, government portals, or mess providers.

1.7 “Confidential Information”
All non-public information shared between the User and Biginius.com in connection with any Service, whether in written, electronic, or oral form, including personal details, academic records, financial documents, and communications.

1.8 “Force Majeure Event”
An event beyond the reasonable control of either party, such as natural disasters, governmental actions, strikes, pandemics, or internet disruptions, which prevents or delays the performance of obligations.

1.9 “Business Days”
Refers to working days excluding Saturdays, Sundays, and public holidays in India.

1.10 “Platform”
The Biginius.com website, mobile application, and any other digital interface or system operated by the Company.

2. Commencement of Service
2.1 General Commencement Rule
Service will commence only after:

• The User successfully completes registration.
• All required documents are submitted and verified; and
• Applicable payments (if any) are received and confirmed by Biginius.com.

2.2 Service-Specific Commencement Criteria

(a) Scholarship Acquisition
Commences once the User’s eligibility documents are reviewed, necessary application forms are prepared, and the process of applying to relevant scholarship schemes is initiated.

(b) College Admission
Commences after document verification, selection of preferred colleges/courses, and formal initiation of application submissions or counselling processes.

(c) Educational Loan
Commences after loan requirement assessment, document verification, and engagement with financial institutions begins.

(d) Mess & Hostel Assistance
Commences upon confirmation of availability from mess/hostel partners and initiation of allocation/booking formalities.

(e) Placement Assistance
Commences upon User profile creation on our platform and inclusion into relevant job preparation or recruitment pipelines.

2.3 Delay in Commencement
If commencement is delayed due to incomplete information, pending documents, or failure to make payment, Biginius.com shall not be liable for missed deadlines or lost opportunities.

2.4 Notification of Commencement
Biginius.com will notify the User of service commencement via email, SMS, or platform notification.

3. Subscription Fees
3.1 Determination of Fees

• Fees vary depending on the service type, package chosen, and any active promotions.
• Fees may be charged as a one-time payment, in instalments, or on a subscription basis.

3.2 Taxes and Additional Charges

• All fees are exclusive of applicable GST and other statutory taxes unless otherwise stated.
• Any payment processing or bank charges shall be borne by the User.

3.3 Non-Refundable Nature
Except where otherwise stated in service-specific refund policies, all subscription fees are non-refundable.

3.4 Fee Revisions
Biginius.com reserves the right to revise fees without prior individual consent; however, existing subscribers will not be affected until the renewal of their subscription.

3.5 Currency
All fees are payable in Indian Rupees (INR) unless otherwise specified.

4. Payment
4.1 Payment Methods
Payments may be made through:

• UPI, Net Banking, Debit/Credit Cards
• Wallet Payments
• Bank Transfers

4.2 Payment Confirmation
A service will be activated only after payment confirmation is received from our payment gateway or bank.

4.3 Late Payment Consequences
Failure to make payments on time may result in:

• Suspension of services
• Additional administrative charges
• Termination of subscription

4.4 Fraudulent Payments
If a payment is found to be unauthorized or fraudulent, Biginius.com may suspend or terminate the User’s account and report the matter to relevant authorities.

5. Cancellation
5.1 User-Initiated Cancellation

A User may request cancellation of a subscribed service at any time by submitting a formal cancellation request via email or the Biginius.com platform dashboard.

For services already commenced, cancellation will not entitle the User to any refund unless otherwise specified in the service-specific refund policy.

5.2 Service-Specific Cancellation Guidelines
(a) Scholarship Acquisition – Cancellation is permitted only before applications are submitted to external portals. Once submission is complete, no cancellation or refund will be processed.
(b) College Admission – Cancellation is possible only before official application/counselling registration is made on behalf of the User.
(c) Educational Loan – Cancellation can be requested before loan applications are lodged with banks or NBFCs.
(d) Mess & Hostel – Cancellation is allowed before accommodation booking is confirmed with the provider.
(e) Placement Assistance – Cancellation is possible before the User’s profile is included in employer outreach campaigns.

5.3 Biginius.com-Initiated Cancellation
We may cancel a User’s subscription if:

• Payment is not received;
• Required documents are incomplete or fraudulent;
• The User violates our Terms of Use or applicable laws.

5.4 Effect of Cancellation
Upon cancellation:

• Service delivery will cease immediately.
• Access to related platform features may be revoked;
• Any outstanding dues will remain payable.

6. Obligations of User/Subscriber
6.1 Accuracy of Information
The User shall provide accurate, current, and complete information during registration and service usage.

6.2 Timely Cooperation
The User shall cooperate by:

• Providing documents within stipulated timelines;
• Responding promptly to queries from Biginius.com;
• Attending scheduled counselling, interviews, or calls.

6.3 Compliance with Laws
The User shall comply with all applicable laws, including education regulations, data privacy rules, and anti-fraud provisions.

6.4 Payment Obligations
The User shall ensure timely payment of fees and charges as per agreed terms.

6.5 Non-Interference
The User shall not interfere with Biginius.com’s operations, staff, or third-party partners.

6.6 Device & Internet
The User shall be responsible for maintaining suitable devices, internet connectivity, and software to access our services.

7. Prohibited Actions
The User shall not, directly or indirectly:

7.1 Misuse of Platform
Use the Biginius.com platform for unlawful, fraudulent, or unauthorized purposes.

7.2 Data Manipulation
Submit forged, altered, or misleading documents or information.

7.3 Intellectual Property Infringement
Copy, reproduce, or distribute Biginius.com content without prior written consent.

7.4 Unauthorized Access
Attempt to hack, bypass security features, or gain unauthorized access to platform systems.

7.5 Spam & Misrepresentation
Send unsolicited communications or misrepresent association with Biginius.com.

7.6 Abuse of Staff or Partners
Engage in abusive, threatening, or harassing behaviour towards Biginius.com representatives or third-party partners.

Violation of this clause may result in immediate suspension or termination of services without refund.

8. Confidentiality & Security
8.1 Mutual Confidentiality
Both Biginius.com and the User agree to protect each other’s Confidential Information from unauthorized access or disclosure.

8.2 Data Handling
All personal and academic data shared by the User shall be stored securely and used solely for providing the agreed services.

8.3 Non-Disclosure
Neither party shall disclose Confidential Information to third parties except:

• To authorised service partners;
• Where required by law;
• With the other party’s written consent.

8.4 Security Obligations of User
The User shall maintain the confidentiality of their login credentials and promptly report any suspected unauthorized account access.

9. Maintenance
9.1 Scheduled Maintenance
Biginius.com may conduct maintenance activities on the platform, with prior notification where possible.

9.2 Emergency Maintenance
In case of urgent technical issues, services may be temporarily unavailable without prior notice.

9.3 Service Availability
We strive for maximum uptime but do not guarantee uninterrupted access due to technical or operational constraints.

9.4 User Responsibilities During Maintenance
The User shall plan submissions and communications to account for potential maintenance downtime.

10. Termination
10.1 Termination by User
The User may terminate this Agreement by cancelling all active services and settling any outstanding dues.

10.2 Termination by Biginius.com
We may terminate this Agreement without prior notice if:

• The User breaches these Terms;
• Fraudulent activities are detected;
• Continued service is impossible due to legal or regulatory restrictions.

10.3 Effects of Termination
Upon termination:

• All rights granted to the User shall cease;
• The User shall immediately stop using the services;
• Biginius.com may retain necessary records as required by law.

10.4 Survival of Clauses
Clauses relating to confidentiality, payment obligations, limitation of liability, indemnity, and governing law shall survive termination.

11. Liabilities upon Termination
11.1 Outstanding Dues
Upon termination, the User shall settle all outstanding payments, including any unpaid subscription fees, penalties, or additional service charges incurred up to the termination date.

11.2 Loss of Access
Termination results in immediate revocation of access to the Biginius.com platform, including but not limited to scholarship tracking, loan status updates, college application progress, hostel booking details, and placement dashboards.

11.3 Non-Refundable Payments
All payments made prior to termination remain non-refundable unless explicitly stated otherwise in service-specific refund policies.

11.4 Return of Materials
Any documents, materials, or property belonging to Biginius.com in the User’s possession must be returned or destroyed upon request.

11.5 Survival of Legal Obligations
Obligations relating to confidentiality, indemnity, limitation of liability, and dispute resolution shall survive termination.

12. Suspension of Service
12.1 Grounds for Suspension
Biginius.com may suspend services temporarily in the following cases:

• Non-payment of fees;
• Suspected fraudulent or illegal activity;
• Violation of Terms of Use;
• Non-cooperation from the User in providing the required documents.

12.2 Duration of Suspension
Suspension will remain in effect until the underlying issue is resolved to Biginius.com’s satisfaction.

12.3 No Refund for Suspension Period
Suspension does not entitle the User to any refund or extension of the service period.

12.4 Immediate Suspension in Emergencies
Biginius.com may suspend services without prior notice if continuing the service poses a risk to the Company’s systems, reputation, or legal standing.

13. Violation of Terms & Conditions
13.1 Consequences of Violation
If the User breaches any provision of these Terms:

• Services may be suspended or terminated;
• Access to the platform may be revoked;
• The matter may be reported to relevant authorities if required by law.

13.2 Investigation Process
Biginius.com may conduct an internal investigation before taking enforcement action, and the User agrees to cooperate fully.

13.3 Liability for Damages
The User shall be liable for any direct or indirect losses caused to Biginius.com or third parties due to the violation.

14. Disclaimer
14.1 Nature of Services
Biginius.com acts as a facilitator and service provider for scholarship applications, college admissions, educational loans, mess/hostel accommodations, and placement assistance. We do not guarantee acceptance, sanction, or selection, as final decisions rest with third-party institutions, banks, government bodies, and employers.

14.2 Information Accuracy
While we make every effort to ensure the accuracy of information provided, Biginius.com shall not be responsible for errors, omissions, or outdated information originating from third-party sources.

14.3 Third-Party Links & Services
The platform may contain links to third-party websites or services. Biginius.com is not responsible for the content, privacy policies, or practices of such third parties.

14.4 Limitation of Advice
Any guidance provided is for informational purposes only and does not constitute legal, financial, or professional advice.

15. Limitation of Liability
15.1 Maximum Liability
To the fullest extent permitted by law, Biginius.com’s total liability to any User shall not exceed the total subscription fees paid by that User in the twelve (12) months preceding the event giving rise to the claim.

15.2 Exclusion of Certain Damages
Biginius.com shall not be liable for:

• Loss of data;
• Loss of business opportunities;
• Indirect, incidental, or consequential damages.

15.3 Force Majeure
We shall not be liable for any failure or delay in performance caused by Force Majeure Events.

16. Use of Information/Data Supplied
16.1 Purpose of Data Collection
User data is collected solely for the purposes of:

• Delivering subscribed services;
• Complying with applicable laws;
• Improving our platform and service offerings.

16.2 Data Sharing
We may share necessary information with:

• Scholarship boards, colleges, banks, hostels, and employers relevant to the service;
• Third-party service providers under confidentiality obligations.

16.3 User Consent
By using our services, the User consents to the collection, storage, and processing of their data as outlined in our Privacy Policy.

16.4 Data Retention
Biginius.com will retain User data only for as long as necessary to fulfil the purposes for which it was collected or as required by law.

17. Indemnity
17.1 User’s Indemnification Obligation
The User agrees to indemnify, defend, and hold harmless Biginius.com, its directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising out of:

• Breach of these Terms;
• Violation of any law or rights of third parties;
• Misuse of services.

17.2 Defence and Settlement
Biginius.com reserves the right to assume exclusive control over the defence of any claim for which it is entitled to indemnification.

18. Confidentiality
18.1 Separate Confidentiality Obligations
This clause supplements Clause 8 (Confidentiality & Security) and applies to all forms of confidential business, operational, or strategic information exchanged between the User and Biginius.com.

18.2 Confidentiality Duration
The confidentiality obligation shall survive for a period of five (5) years after termination of the Agreement.

18.3 Exceptions
Disclosure is permitted only:

• With prior written consent;
• Where required by law;
• To protect legal rights or prevent fraud.

19. Variation
19.1 Right to Modify
Biginius.com reserves the right to amend, modify, or update these Terms at any time without prior individual notice, provided that updates are posted on the platform.

19.2 Continued Use as Acceptance
Continued use of services after changes take effect constitutes acceptance of the revised Terms.

20. Discontinuation or Modification to Services
20.1 Right to Discontinue
We may discontinue any service, in whole or part, for business, operational, or regulatory reasons.

20.2 Service Modification
We may modify the scope, features, or pricing of services at our discretion, provided Users are notified of significant changes.

20.3 Effect on Existing Users
Where discontinuation affects ongoing subscriptions, Biginius.com may, at its discretion, offer alternative services or partial refunds as applicable.

21. Notices
21.1 Method of Communication
All notices, communications, or official correspondence between the User and Biginius.com shall be in writing and may be delivered by:

• Email (to the registered email address of the User or official Biginius.com address);
• Platform notifications;
• Courier or registered post to the official address of either party.

21.2 Effective Date of Notice

• Email: On the date of transmission (if no delivery failure notification is received);
• Courier/Post: On the date of receipt as recorded by the delivery service.

21.3 Responsibility to Update Contact Details
The User shall ensure that their contact details remain accurate and updated to receive all notices promptly.

22. Non-exclusive Remedy
22.1 Rights Not Limited
The remedies provided in these Terms are cumulative and not exclusive of any other rights or remedies available under applicable law.

22.2 No Limitation
Exercising one remedy does not prevent the exercise of any other remedy permitted by law or equity.

23. Waiver
23.1 No Waiver by Conduct
Failure or delay by Biginius.com to exercise any right under these Terms shall not constitute a waiver of that right.

23.2 Written Waiver Required
Any waiver of rights must be in writing and signed by an authorized representative of Biginius.com to be valid.

24. Entire Agreement
24.1 Complete Understanding
These Terms, along with the Privacy Policy, Refund Policies, and any applicable service-specific agreements, constitute the entire agreement between the User and Biginius.com regarding the use of services.

24.2 Superseding Prior Agreements
These Terms supersede any prior understandings, agreements, or communications, whether oral or written, related to the subject matter herein.

25. Governing Law and Jurisdiction
25.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of India.

25.2 Jurisdiction
All disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in [Insert City, e.g., Bhubaneswar, Odisha], India.

26. Acknowledgment and Acceptance of Terms and Conditions
26.1 User Declaration
By accessing or using Biginius.com’s services, the User acknowledges that they have read, understood, and agreed to these Terms of Use in full.

These Terms form a legally binding agreement between the User and Biginius.com, enforceable under applicable law.

27. Privacy Policy

The collection, processing, and storage of personal data shall be governed by the Privacy Policy available on the Biginius.com platform.

27.2 User Consent
By using the services, the User consents to the collection, use, and sharing of their information as described in the Privacy Policy.

28. Endorsement Reward Program
28.1 Eligibility
Registered Users of Biginius.com may participate in the Endorsement Reward Program by referring new Users to the platform.

28.2 Rewards
Rewards may be in the form of cash incentives, service credits, or other benefits as specified from time to time.

28.3 Fraud Prevention
Biginius.com reserves the right to withhold rewards or disqualify participants if fraudulent referrals or unethical practices are detected.

29. RESUMATHON Offer
29.1 Description
The RESUMATHON Offer is a promotional initiative aimed at enhancing job readiness for eligible students through resume-building workshops, mock interviews, and career counselling sessions.

29.2 Eligibility Criteria
Participation is open to Users who:

• Are currently enrolled in a college/university;
• Have an active subscription to Biginius.com’s Placement Assistance service.

29.3 Offer Period
The RESUMATHON Offer shall be valid for a limited time, as communicated via platform announcements.

29.4 Modification or Termination of Offer
Biginius.com reserves the right to modify, extend, or terminate the RESUMATHON Offer without prior notice.

IN WITNESS WHEREOF, by continuing to use Biginius.com’s services, the User confirms their acceptance of these Terms of Use.
